By accessing and using the website of Red Maple Care Pty Ltd ("the Website"), you acknowledge and agree to these Conditions of Use. If you do not agree, please do not use our Website.

2. Website Content & Accuracy

  • 2.1Our Website contains information about Aged Care, NDIS services, and Home Care Packages. While we make every effort to ensure the information is accurate and up to date, errors may occur.
  • 2.2To the extent permitted by law, Red Maple Care does not warrant the accuracy, adequacy, or completeness of any information contained on this Website. We exclude liability for any decisions made on the basis of information included or excluded from this Website.
  • 2.3The content on this Website is for general information purposes only and does not constitute professional medical, legal, or financial advice.

3. Technology & Security

  • 3.1We do not guarantee that our Website will be free from viruses, malware, or other forms of technical sabotage.
  • 3.2We accept no responsibility for any foreign computer code that is introduced into your computer system through the use of this Website. You are responsible for implementing your own security and virus protection measures.

4. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, Red Maple Care excludes all liability for any loss or damage (including indirect or consequential loss) arising out of your use of the Website or reliance on Website Information.

5. Privacy

You acknowledge and agree that Red Maple Care may collect and use your personal information in accordance with the Red Maple Care Privacy Policy.

6. Jurisdiction

This Website is intended for residents of Australia. These Terms & Conditions are governed by the laws of New South Wales.

Part 2: Promotional Terms & Conditions

Applies to the "$200 Voucher", "Right Fit Guarantee", and Referral Offers.

1. Definitions

  • "The Company" refers to Red Maple Care Pty Ltd (ABN 48 681 401 525).
  • "The Approved Provider" refers to Trilogy Care or the relevant Plan Manager holding the participant's government funding.
  • "Eligible Services" refers to personal care, domestic assistance, gardening, and social support delivered directly by Red Maple Care employees. It excludes brokerage services, third-party contractors, travel charges, and reimbursements.

2. The "Meet the Team" Voucher ($200 Service Credit)

  • 2.1Eligibility: Valid for new clients who sign a Service Delivery Agreement with Red Maple Care. Clients must have an active Home Care Package (HCP), Support at Home budget, or NDIS plan managed by Trilogy Care or a compatible Plan Manager.
  • 2.2Application of Credit: The $200 credit is applied as a discount to the service fees invoiced by Red Maple Care.
  • 2.3Funding Integrity: This credit is funded solely by Red Maple Care’s corporate operating account. It is not claimed as a subsidy from the client’s government package.
  • 2.4
    Exclusions: The credit cannot be used to pay:
    • (a) Government-mandated consumer contributions (e.g., Basic Daily Fee, Income Tested Fee, or mandatory co-contributions under the Support at Home program).
    • (b) Management or administration fees charged by the Approved Provider (Trilogy Care).
    • (c) Third-party goods, equipment, or sub-contracted services.

3. The Referrer Reward ($200 Gift Card)

  • 3.1Eligibility: Open to existing clients, family members, or community members who refer a new eligible client to Red Maple Care.
  • 3.2Trigger: The Gift Card is issued only after the referred client has signed a Service Agreement and completed 20 hours of invoiced, employee-delivered services.
  • 3.3Payment: The reward is paid from Red Maple Care’s marketing budget. It is never deducted from any client’s Home Care Package or NDIS funds.

4. The "Right Fit" Guarantee (The "Happy Day" Promise)

  • 4.1The Promise: If a client is dissatisfied with the compatibility or quality of a support worker during their first shift with that worker, Red Maple Care will waive the cost of that specific shift.
  • 4.2Notification: To claim this guarantee, the client must notify Red Maple Care management by phone or email within 48 hours of the conclusion of the shift.
  • 4.3
    Financial Adjustment:
    • (a) Upon a successful claim, Red Maple Care will void the invoice for that shift.
    • (b) No claim will be made against the client's NDIS plan or Home Care Package for the disputed shift. Red Maple Care absorbs this cost directly.
  • 4.4Limitations: This guarantee applies only to the first shift with a specific worker.

5. The "No Awkwardness" Switch Policy

  • 5.1Policy: Clients verify their right to request a change of support worker at any time, for any reason, without the need for confrontation or detailed explanation to the worker.
  • 5.2Process: The client must contact Red Maple Care management to request a "Switch." We will handle all communication with the previous worker regarding the cessation of their shifts.

6. General Promotional Terms

  • 6.1No Cash Value: Credits and vouchers are not redeemable for cash or transferable to other providers.
  • 6.2Relationship Disclosure: Red Maple Care acts as a Service Provider. We are not the Approved Provider holding your government funds. All agreements for government funding remain between the participant and their Approved Provider (e.g., Trilogy Care).
  • 6.3Expiry: Vouchers expire 6 months from the date of issue.
  • 6.4Limit: One voucher per household.
